LIMITATIONS ON HUMAN RIGHTS IN FRANCE TO COUNTERACT TERRORISM

Background. In accordance with Article 55 of the RF Constitution, the rights and freedoms of individuals and citizens can be limited by the federal law for certain purposes. The possibility of limiting human rights can certainly be exercised in order to counteract terrorism. This rule is recognized by all democratic states. To understand the meaning and purpose of such restrictions, one must turn to foreign experience. Within the framework of this article, the experience is based on the limitations of human rights to counteract terrorism, which is being tested in France. The research objective is to investigate the legislation of France establishing legal mechanisms for counteracting terrorism and to analyze its content.
Materials and methods. The research tasks were implemented through analyzing the existing normative acts of France and Russia, clarifying their meaning, specific forms and methods of restrictions on human rights established to combat terrorism. The research methodology included legal regulation analysis, formal legal and comparative legal methods.
Results. The author has singled out peculiar contents of the latest legislative novels in the French legislation, conditioned by the terrorist acts of 2015–2016. The powers of law-enforcement bodies in this sphere have been determined.
Conclusions. It is emphasized that the French legislation is dinstinguished by its rigidi ty and the introduction of significant administrative measures against citizens suspected of terrorist activities (or contributing to it). The country has administered police control, which has similar features with administrative supervision over conditionally convicted citizens.
